Endesa appeals fined by the SMA to Bocamina II

In mid-August, the SMA will fined 8640.4 UTA ($ 4.378 million) to Endesa for breaches of its environmental permit.

On Monday at the third environmental court, based in Valdivia, Endesa’s Generator filed a complaint appeal in which it requests rescission the penalty imposed by the superintendent of environment (SMA) in mid-August by defaults on its Bocamina power plant .-

The SMA will fined 8640.4 UTA ($ 4.378 million) to Endesa for breach of the conditions, rules and measures in the Environmental Qualification Resolution of the Project “Bocamina Second Thermal Power Unit Expansion”.

On appeal Endesa claims that the resolution of the SMA is illegal and lacks foundation.

It also requests “explicitly stated that Endesa holds an environmental rating in force under which the unit can operate Bocamina II”.

The Bocamina II plant has been paralyzed since December 17 by the Court of Appeals of Concepción, upholding an injunction, while solving regarding an injunction filed by Coronel’s fishermen and residents.

Then the same court decided to establish conditions for Endesa in order it could return to operate the plant. Both parties appealed to the Supreme Court which will announce its decision in the coming weeks.
